These terms are an agreement between you and Safebay PRO LLC, a Nevada limited liability company ("SafeBay," "we," "us"). They cover the website at safebay.store, the SafeBay Companion Chrome extension, the SafeBay apps for Android, iPhone and iPad, and SafeBay TV (the TV board and its apps for Roku, Samsung, Google TV and Amazon Fire TV), together "SafeBay." By creating an account or using SafeBay you agree to them. If you use SafeBay for a business, you agree for that business.
How we handle personal information is described in our Privacy Policy, which is part of these terms.
You must be at least 18 and give accurate information. Keep your password and second factor to yourself; you are responsible for what happens in your account, including on devices and TVs you link to it. Tell us at once at support@safebay.store if you think someone else is using it.
You can delete your account at any time in your profile or in the apps. Deleting it ends a paid plan immediately, without a refund for the rest of the period.
SafeBay is not affiliated with, endorsed by or sponsored by eBay. When you connect your eBay store, you authorize SafeBay to act on it through eBay's official APIs for the features you turn on, such as syncing orders, listings and messages, relisting, sending replies and auto-replies, and blocking buyers. You remain responsible for your store and for following eBay's User Agreement and policies. eBay can change or limit its APIs, and features that depend on them may change or stop as a result.
Paid plans are billed in advance through Stripe, monthly or yearly, and renew until you cancel. You can cancel at any time; a cancelled plan stays active until the end of the period you paid for. Except where the law requires otherwise, payments are not refundable. We may change prices with notice before your next renewal.
Wallet credit given as a promotion, such as the welcome credit for new accounts, can be spent on SafeBay plans only. It has no cash value and cannot be withdrawn. Deposited funds can be withdrawn as described on the wallet page, less any amount spent.
Sellers can report buyers, and reports that pass review can appear to other sellers. Report only your own real experiences with a buyer, accurately and without personal information beyond what the form asks for. Do not report to retaliate, harass or mislead. We may review, edit, hide or remove any report, and suspend accounts that misuse reporting. Buyers can appeal a report, and we may remove it after an appeal.
The community list is information from other sellers. SafeBay does not verify every report and does not decide whom you do business with: that decision, and following eBay's rules when you block a buyer, are yours.
Some features use AI to suggest listing text, item specifics, prices, replies to buyers and other content. AI output can be wrong or incomplete. Check it before you publish or send it: you are responsible for your listings and messages, including ones SafeBay sends automatically under rules you set.
Do not use SafeBay to break the law or anyone's rights, to send spam, to access accounts or data that are not yours, to scrape or overload SafeBay, to probe or bypass its security, or to copy or resell it. Show the TV board only where the people who can see it may see your orders and buyers' eBay IDs.
You keep your rights in what you upload or create: listings, photos, messages, reports and settings. You give SafeBay the permission it needs to store, process and display that content to provide the service, including sending it to eBay and to the service providers named in the Privacy Policy. Reports you submit to the community list may be shown to other sellers as described above.
We improve SafeBay continually and may add, change or remove features. We aim to keep it running but do not promise it will always be available or error-free. We may suspend or close accounts that break these terms; you can stop using SafeBay at any time.
SafeBay is provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.
To the extent the law allows, SafeBay is not liable for indirect, incidental, special or consequential damages, or for lost profits, sales, data or goodwill, and its total liability for any claim about SafeBay is limited to the amount you paid SafeBay in the 12 months before the claim. Some places do not allow these limits, so they may not all apply to you.
You agree to cover SafeBay for claims by others that arise from your content, your reports or your breach of these terms.
These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Nevada, unless the law where you live gives you the right to bring them elsewhere.
We may update these terms. When we do, we change the date at the top, and for material changes we tell you by email or in SafeBay before they take effect. Using SafeBay after that means you accept the updated terms.
